CONDITIONS & TERMS FOR USE OF SERVICEMEN

Requesting the service member to disobey any laws for any reason. Such a request by the consumer may be declined by the Serviceman. Additionally, the Serviceman is free to decline the job or depart the customer's home.


Utilising the service or the software illegally or to disturb, irritate, or inconvenience others.

Sharing of private data, including your password, etc.

The customer agrees and acknowledges that using the services provided by the company is done so at their own risk and that, to the fullest extent permitted by law, the company makes no representations or warranties of any kind, either express or implied, regarding condition, suitability, quality, merchantability, or fitness for any particular purpose.

TERMINATION

Visitors to the website can access the majority of the content and some services without paying any money. However, DRIVERS BOOKING has the right to revoke access to any part of the website, including any part of a feature, at any time and for any reason, with or without prior notice. In order to safeguard the interests of DRIVERS BOOKING and/or other website visitors, DRIVERS BOOKING also has the unrestricted right to refuse access to any or all of its Services to specific users without prior warning or justification. DRIVERS BOOKING maintains the right to modify any function or add new features without prior notice, as well as to restrict, refuse, or create different access levels to the website and its features with respect to different user(s).

4. Every effort is taken to maintain the website's availability and functionality. However, due to technical problems outside of our control, Drivers Booking disclaims all liability and will not be held liable if the website is momentarily unavailable.

5. We provide an optional Trip Protection Plan when you book a driver using the app, at a nominal cost by opting for Chiku Mobility India Pvt Ltd. When you book a trip on Chiku Mobility, you will be asked to ‘Secure your booking’ prior to requesting a driver. This protection plan is valid through the duration of this trip. The details of coverage are also provided on call or mail and specified in the last section of this T&C. This Trip Insurance is not available if you book your driver through the website or phone booking.

6. Should you choose or not be able to procure this plan offered by Chiku Mobility India Pvt Ltd, we are not responsible for any vehicle damage during the service.

7. Joining of duty will be subject to confirmation only after acceptance of terms of service and terms of employment by duly signing.

8. Chiku Mobility India Pvt Ltd will not be responsible if the employer gives advance, mobile, uniform, etc., to the employed driver.

9. In case the driver goes on leave for 1 or more days, we will arrange a temporary driver for you at an extra charge. That charge can be deducted from your driver's salary.

10. If you want to discontinue the driver from the job, you need to give him a 1-week notice, and during this notice period, you can avail of a replacement from the company at no extra cost.

11. The customer can replace the driver anytime if they are not satisfied with the driver at no extra cost.

12. We have fully verified the driver's references, including previous employers, social circle, and documents.

13. Any dispute will be under the jurisdiction of the Varanasi court only.

14. In case of any unfortunate event or damage during the trip, responsibilities will be governed by the insurance company and the car owner. Chiku Mobility India Pvt Ltd or the driver will not be liable for damages caused by accidents or natural calamities.

15. If the driver does not reach the pick-up point on time for any reason, then 2 hours' time will have to be given to arrange another driver.

16. If the customer does not inform the company regarding the driver's denial of a trip within 30 minutes of the pickup time using the registered number, it will be considered a no-show case, and no refund will be applicable.

17. Membership fees for any kind of driver service are non-refundable in any case.

18. The company will assign the best driver as per your choice and will provide options if you are not satisfied with the assigned driver.

19. No refunds will be applicable after taking or availing of the service.

20. It is mandatory for both the customer and the driver to submit a duly completed and signed duty slip and feedback form at the end of the trip. Chiku Mobility will not entertain any disputes regarding the trip in the absence of a duty slip.

21. Chiku Mobility India Pvt Ltd is a driver service provider. The customer will be the employer of the assigned driver.

22. Chiku Mobility India Pvt Ltd will not be liable for any act of the driver during their employment with the customer.

23. Information provided by the driver is authenticated by the driver. The company is only liable for background verification.

24. The company is not liable for damages caused due to accidents during duty time. The company follows strict vetting procedures for recruiting drivers.

25. Customers are responsible for checking and safeguarding belongings during duty time. The company is not liable for property loss or damage.

26. The company works only as a service provider of drivers and is not liable for jurisdiction procedures in court.

27. Replacement drivers will be provided within 5–7 days if the driver is no longer in service with the customer.

28. The company will notify customers at least 4 days in advance for driver replacements. A maximum of 4–5 screened drivers will be provided during the service period.

29. We do not procure insurance for damage or loss of personal belongings or vehicles. The user is responsible for obtaining required insurance coverage. Driver replacement will depend on valid reasons.

JURISDICTION

We are not party and not responsible for any kind of dispute related to vendor / driver and customer. However if required , the jurisdiction for any kind of dispute with CHIKU MOBILITY INDIA PVT LTD would be Varanasi district court only.
